Welcome to Sleek Web Studio. These Terms & Conditions ("Terms") govern your use of the Sleek Web Studio website and the purchase and use of our website design, development, maintenance, and related services.
By purchasing a service, submitting payment, approving a proposal or project, or otherwise engaging Sleek Web Studio for services, you agree to these Terms.
1. Services
Sleek Web Studio provides website design, development, setup, customization, maintenance, and related digital services.
Services may include, depending on the package or agreement selected:
Website design and development
Responsive/mobile optimization
Contact and lead forms
Basic search engine optimization (SEO) setup
Google Maps integration
Google Business Profile assistance
E-commerce setup
Online booking setup
Custom styling
Custom code and integrations
Website maintenance and support
The exact scope of each project is determined by the package, proposal, invoice, or other written agreement between Sleek Web Studio and the client.
2. Website Design Packages
Sleek Web Studio currently offers Starter, Business, and Premium website packages.
Each package includes a specified number of pages, features, and revision rounds as described at the time of purchase.
Requests outside the selected package's scope may result in additional charges.
Additional pages, features, integrations, revisions, e-commerce functionality, booking functionality, or other services not originally included may be quoted separately.
3. Payments
Unless otherwise agreed in writing, website projects require a 50% non-refundable deposit before work begins.
The remaining 50% balance is due before the completed website is launched, transferred, or otherwise delivered to the client.
Sleek Web Studio is not required to launch or transfer a website until all outstanding amounts associated with the project have been paid.
Additional work requested outside the original project scope may require additional payment.
4. Deposits, Cancellations & Refunds
Project deposits reserve time on Sleek Web Studio's schedule and allow work on the project to begin. Therefore, deposits are generally non-refundable once work has commenced.
If a client cancels a project after work has started, amounts already paid may be retained to compensate Sleek Web Studio for work performed, time reserved, and expenses incurred, subject to applicable law.
If Sleek Web Studio cancels a project before completing the agreed services, any refund will be determined based on the amount paid, work already completed, expenses incurred, and applicable law.
Nothing in these Terms limits any refund or cancellation rights that cannot legally be waived.
5. Revisions
Website packages include a specified number of revision rounds.
A revision round consists of a reasonable group of design or content changes submitted together after the client reviews a website draft.
Revisions may include reasonable changes such as:
Colors
Fonts
Images
Text
Spacing
Section arrangement
Button styles
Other reasonable design adjustments
A revision does not include a complete redesign, additional pages, major new functionality, or features outside the original project scope.
Requests outside the included revision rounds may require an additional revision fee.
Corrections required because of an error made by Sleek Web Studio will not count as a client revision.
6. Client Responsibilities
The client is responsible for providing the information and materials reasonably necessary to complete the project.
This may include:
Business information
Written content
Logos
Images and videos
Product information
Service information
Pricing
Contact information
Account access when necessary
Feedback and approvals
The client represents that they have the necessary rights or permissions to use all materials supplied to Sleek Web Studio.
Sleek Web Studio is not responsible for copyright, trademark, licensing, or other claims resulting from materials provided or specifically requested by the client.
7. Project Timelines
Any estimated completion date is an estimate unless Sleek Web Studio expressly agrees in writing to a guaranteed deadline.
Project timelines depend on client communication, content delivery, approvals, requested revisions, third-party services, and the complexity of the project.
Delays in receiving client materials, feedback, payment, or approvals may extend the completion date.
8. Inactive Projects
If the client fails to provide required materials, feedback, approvals, or communication for an extended period, Sleek Web Studio may place the project on hold.
If there is no meaningful client response for 30 days, the project may be considered inactive.
Restarting an inactive project may be subject to current availability and, where disclosed and agreed, an additional restart fee.
9. Third-Party Platforms
Websites created by Sleek Web Studio may use third-party platforms and services, including Squarespace, domain registrars, payment processors, scheduling providers, Google services, email providers, and other integrations.
These third-party services have their own terms, policies, prices, limitations, and availability.
Sleek Web Studio does not own or control these third-party platforms and cannot guarantee that their pricing, functionality, policies, or availability will remain unchanged.
10. Squarespace Subscriptions
Unless specifically included in a written Website Care or management agreement, Squarespace website subscriptions are separate from Sleek Web Studio's website design fees.
The client is responsible for maintaining an active Squarespace subscription after ownership or billing responsibility is transferred to them.
If Sleek Web Studio manages the Squarespace subscription through a Website Care Plan, applicable platform costs may be included in the client's recurring fee as specified in that plan.
Squarespace is an independent third-party service provider and is not owned or operated by Sleek Web Studio.
11. Domains
Whenever practical, clients should own and control the domain name associated with their business.
If Sleek Web Studio assists with domain registration, connection, transfer, or renewal, the client remains responsible for providing accurate registration information and complying with the domain provider's requirements.
Domain registration and renewal fees are separate unless specifically stated as included in a Website Care Plan or other written agreement.
12. Website Care Plans
Clients may have the option to purchase recurring Website Care or website management services.
Depending on the selected plan, these services may include website platform costs, routine maintenance, minor content updates, technical support, website monitoring, and other services specifically described when purchased.
Website Care does not include unlimited redesigns, new pages, major functionality, or substantial development unless expressly included.
Recurring fees are charged according to the billing schedule agreed upon when the plan is purchased.
A client may cancel recurring services subject to the cancellation terms presented with the applicable plan.
13. E-Commerce & Payment Processing
If Sleek Web Studio configures an online store or payment system, transactions may be processed by third-party payment providers.
The client is responsible for maintaining required merchant accounts and complying with applicable tax, refund, shipping, consumer protection, and other legal requirements associated with their products or services.
Sleek Web Studio does not guarantee approval by any payment processor and is not responsible for payment processor holds, disputes, chargebacks, account suspensions, transaction fees, or service interruptions.
14. Online Booking
Online booking features may rely on Squarespace Scheduling/Acuity or another third-party scheduling provider.
Scheduling services may require a separate subscription.
Unless expressly included in the client's agreement, third-party scheduling fees are the client's responsibility.
15. Search Engine Optimization
When SEO setup is included, Sleek Web Studio may optimize elements such as page titles, descriptions, image alt text, URLs, content structure, and other basic on-page SEO elements.
However, Sleek Web Studio does not guarantee specific search rankings, website traffic, leads, sales, or placement on Google or any other search engine.
Search engine rankings are controlled by third parties and depend on many factors outside Sleek Web Studio's control.
16. Google Business Profile
When Google Business Profile setup or optimization is included, Sleek Web Studio may assist the client with creating, claiming, configuring, or optimizing the profile.
Google controls verification, approval, ranking, suspension, and availability of Google Business Profiles.
Sleek Web Studio cannot guarantee verification, approval, placement, or search ranking.
17. Ownership of the Completed Website
Upon full payment of all project fees, the client will receive the rights to the final custom website content and design work created specifically for the client, except for third-party materials, licensed assets, software, templates, platform components, and other materials subject to separate licenses or ownership rights.
Until full payment has been received, Sleek Web Studio retains its rights in unpaid custom work to the extent permitted by law.
Squarespace's platform, templates, software, and other proprietary components remain subject to Squarespace's terms and ownership.
18. Portfolio Rights
Unless otherwise agreed in writing, the client grants Sleek Web Studio permission to display the completed website, screenshots, client name, and a general description of the project in Sleek Web Studio's portfolio, website, social media, and marketing materials.
Clients may request in writing that confidential or sensitive information not be displayed.
19. Client Approval
The client is responsible for reviewing the website before final launch.
Approval indicates that the client has reviewed the site's design, content, contact information, links, products, services, pricing, and other client-supplied information.
After final approval and launch, substantial changes may be treated as additional work.
20. Website Performance & Availability
Sleek Web Studio will make reasonable efforts to deliver functional websites according to the agreed project scope.
However, we cannot guarantee uninterrupted website availability, error-free operation, compatibility with every future browser or device, or uninterrupted operation of third-party services.
Sleek Web Studio is not responsible for outages or failures caused by hosting providers, domain registrars, payment processors, third-party integrations, internet providers, platform changes, cyberattacks, or circumstances outside our reasonable control.
21. Limitation of Liability
To the maximum extent permitted by applicable law, Sleek Web Studio will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services.
To the maximum extent permitted by law, Sleek Web Studio's aggregate liability arising from a particular project will not exceed the amount actually paid to Sleek Web Studio for the services giving rise to the claim.
Some jurisdictions do not permit certain liability limitations, so these limitations apply only to the extent permitted by applicable law.
22. No Guarantee of Business Results
A professionally designed website can support a business's marketing and online presence, but Sleek Web Studio does not guarantee any specific financial or business outcome.
We do not guarantee increased revenue, customers, leads, website traffic, conversions, or other business results.
23. Privacy
Personal information collected through our website and services is handled according to our Privacy Policy.
Clients are responsible for ensuring that their own websites have appropriate privacy policies, terms, disclosures, cookie notices, and other legally required information applicable to their businesses.
Unless specifically contracted to provide such services, Sleek Web Studio does not provide legal advice.
24. Changes to These Terms
Sleek Web Studio may update these Terms from time to time.
Changes will be reflected by updating the "Last Updated" date. Changes will apply prospectively unless otherwise permitted by law and will not retroactively alter an already agreed project scope or payment obligation merely by posting revised website terms.
25. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute concerning these Terms or services provided by Sleek Web Studio will be handled in accordance with applicable Texas and federal law.
